What is Medical/Clinical Negligence

Most Clinical Negligence cases involve one of the following:

  • A Delay in diagnosis which reduces prospects of recovery being reduced
  • Poorly performed surgery
  • Incorrect treatment
  • The failure of a medical device or product
  • A bad reaction to a medication or drug
  • Failure to get consent for treatment which then results in a poor outcome

What do we have to prove?

In a Clinical Negligence claim we will need to prove that the treatment you received:

a.)Was substandard in that it fell below the lowest acceptable standard of that treating medical professional

b.)Caused you to suffer injury or a poorer outcome than you were entitled to expect

Both of these elements must be proven for the case to succeed.
